1. Acceptance of terms

By accessing empreintevie.ca, creating an account, filling out a form, ordering a product, or using a service offered by Empreinte Vie Inc., you accept these terms of use.

If you do not accept these terms, you must stop using the site and the services. Certain orders, signups, or features may also be subject to additional terms presented at the time of purchase or use.

2. Description of services

Empreinte Vie Inc. offers, among other things:

• The creation and management of digital memory profiles.
• Spaces that allow you to add text, photos, videos, dates, quotes, memories, and family connections.
• Plaques, commemorative products, and QR products that can be connected to an Empreinte profile.
• An account area where you can manage certain profiles, orders, and information.
• Support, guidance, and personalization services.

Services may evolve over time. Empreinte Vie Inc. may modify, improve, suspend, or remove certain features when necessary.

3. Customer account and access

Certain features require the creation of a customer account. You are responsible for the accuracy of the information provided, the confidentiality of your credentials, and any activity carried out through your account.

You must inform us promptly if you believe unauthorized access to your account has occurred. Empreinte Vie Inc. may suspend or limit access in cases of abusive, fraudulent, unauthorized use, or use contrary to these terms.

The primary account linked to an Empreinte may invite a loved one to collaborate on that profile. As long as access remains active, the invited person may modify the Empreinte, update information, and add memories. The primary account remains responsible for the access it grants and may withdraw that access at any time.

4. User-submitted content

You retain the rights you hold in the texts, photos, videos, files, testimonials, and other content you provide to Empreinte Vie Inc. However, you grant us a non-exclusive authorization to use, host, reproduce, adapt, display, and process this content only to the extent necessary to provide the requested services.

You confirm that:

• You have the right to provide the content submitted.
• The content does not infringe the rights of others, including copyright, image rights, privacy rights, or intellectual property rights.
• The content is not defamatory, hateful, fraudulent, obscene, threatening, or otherwise unlawful.
• Content concerning another person is submitted with appropriate authorization when required.

Empreinte Vie Inc. may refuse, remove, or request the modification of content that appears inappropriate, unlawful, abusive, or contrary to the spirit of the services.

5. Orders, pricing, and payments

Prices, descriptions, options, timelines, and availability of products or services are shown on the site at the time of ordering, subject to errors, corrections, or reasonable changes.

Applicable taxes, delivery fees, personalization fees, or other charges will be shown when required before or during checkout. Payment must be authorized and completed using the methods offered on the site.

Some clients may receive an invitation linked to an authorized partner of Empreinte Vie Inc. When a partner benefit is offered, it remains conditional on the use of a valid unique invitation link and on the client’s eligibility under the applicable terms. A simple partner code entered without a valid invitation does not automatically create a right to a discount, benefit, or commission.

Unless otherwise stated in a specific agreement, partner benefits and related commissions apply only to a first eligible purchase, calculated on the subtotal before taxes. Empreinte Vie Inc. may correct, refuse, withdraw, or cancel a partner benefit or commission in case of error, non-compliant use, duplication, abuse, suspected fraud, or failure to respect the program terms.

Empreinte Vie Inc. may refuse or cancel an order in case of obvious error, payment issue, suspected fraud, incomplete information, or a reasonable inability to provide the requested product or service. Rights provided by applicable laws, particularly consumer protection laws, remain applicable.

6. Delivery, production, and timelines

Production or delivery times may vary depending on the product, level of personalization, material availability, information validation, suppliers, carriers, or other circumstances beyond our control.

When content, visuals, names, dates, or instructions are required to produce a product, timelines may begin only after receiving and validating the necessary elements.

7. Cancellation, changes, and refunds

Requests for cancellation, modification, or refund are assessed based on the nature of the product or service, the stage of the order, the level of personalization, and applicable rights.

Certain personalized products or products already in production may not be cancellable or refundable, unless required by law or where an error attributable to Empreinte Vie Inc. is confirmed. If a product is defective, damaged, or non-compliant, we invite you to contact us promptly so that we can assess the situation.

8. Public and private profiles and QR codes

An Empreinte profile may be public, shared by link or QR code, or password protected where that option is available. You are responsible for choosing what information you want to make visible.

QR codes and links associated with a profile may be consulted by people who have access to them. Empreinte Vie Inc. cannot control all external uses of a link or QR code once it has been shared publicly or affixed to a physical product.

9. Empreinte Vie intellectual property

The site, design, texts, visual elements, logos, trademarks, interfaces, structures, features, and content created by Empreinte Vie Inc. are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, commercially exploit, or reuse these elements without prior written authorization, except where such use is expressly permitted.

10. Prohibited uses

You agree not to use the site or services to:

• Transmit unlawful, fraudulent, hateful, threatening, defamatory, or abusive content.
• Impersonate another person or provide false information.
• Infringe the rights, privacy, or reputation of others.
• Attempt to access an account, system, or profile without authorization.
• Interfere with the functioning, security, or technical infrastructure of the site.
• Use the site for automated, abusive, or incompatible purposes with the services offered.

11. Responsibilities and limitations

Empreinte Vie Inc. makes reasonable efforts to provide a reliable, secure, and accessible site. However, we cannot guarantee that the site will be available at all times without interruption, error, delay, data loss, or technical incompatibility.

To the extent permitted by law, Empreinte Vie Inc. cannot be held liable for indirect damages, loss of profits, loss of data, service interruptions, errors arising from information provided by the user, or unauthorized use of a public profile, link, or QR code.

Nothing in these terms limits the rights granted to you under applicable consumer protection laws.

12. Protection of personal information

The collection, use, retention, and sharing of personal information are described in our privacy policy. By using the site and services, you acknowledge that your information will be handled in accordance with that policy.

13. Suspension or termination of services

Empreinte Vie Inc. may suspend or limit access to an account, profile, or feature in case of non-compliance with these terms, abusive use, security risk, payment default, or a valid legal request.

You may request the closure of an account or deletion of certain content, subject to applicable legal, accounting, contractual, or technical obligations.

14. External links

The site may contain links to third-party websites, tools, platforms, or services. Empreinte Vie Inc. is not responsible for the content, availability, security, or practices of those external sites or services.

15. Changes to the terms

Empreinte Vie Inc. may update these terms to reflect changes in its services, practices, or legal requirements. The date of the latest update will be shown at the top of the page.

Continued use of the site or services after a change means that you accept the updated terms, subject to applicable rights.

16. Governing law

These terms are governed by the applicable laws of Quebec and Canada. Any dispute will be handled in accordance with competent laws and courts, subject to the protections and remedies granted to consumers by law.
